3. Orders & Acceptance

• Accuracy: By placing an order, you confirm that the items, quantities, prices, and shipping address are completely correct.
• Order Refusal: Your receipt of an electronic order confirmation does not signify our final acceptance of your order. We reserve the right to refuse, limit, or cancel any order at our sole discretion at any time before shipment, for example, if a product is mispriced, out of stock, appears fraudulent, or is flagged as an unauthorized commercial bulk purchase.
• No Purchase for Resale: Products sold on candyroom.ca are intended for personal consumer use only. We reserve the right to limit or prohibit orders that, in our judgment, appear to be placed by unauthorized dealers, resellers, or distributors.

4. Prices, Taxes & International Duties

• Currency: All prices are displayed and charged in Canadian Dollars (CAD) unless otherwise stated.
• Taxes: Prices exclude taxes. Standard sales tax is calculated at checkout based on the provincial or regional regulations of your shipping address.
• International Shipping: For orders shipped outside of Canada, you are the Importer of Record. You are solely responsible for ensuring the product can be lawfully imported to the destination country and for paying all applicable import duties, taxes, and customs clearance fees levied once a shipment reaches your country.
• Promotions: Discount codes cannot be applied retroactively and can be revoked at any time before checkout is completed.

5. Payment

We securely accept payments through Shopify Payments and other processors shown at checkout. Your sensitive payment details are encrypted and processed entirely by our third-party provider; they never touch or reside on our servers.

6. Shipping, Returns & Weather Risks

• Policy Integration: Our Shipping & Returns policy governs delivery times, rates, restrictions, and return rules. That policy is fully integrated into these Terms.
• Weather & Melting Disclaimer: We curate and pack the highest quality treats, but we cannot control the weather. The Candy Room is not responsible or liable for meltable items (such as chocolates or gummies) that suffer heat damage during transit. Please monitor local temperatures and choose expedited shipping options during warmer months.

7. Product Information & Accuracies

We do our best to keep product photos, descriptions, ingredient lists, and weights accurate, but small manufacturer variations can happen. If an item arrives meaningfully different from what we described, please contact us within 7 days of delivery for a review, refund, or replacement consideration.

8. Allergens & Dietary Information

Allergen Warning: Our facility and the facilities of our suppliers handle peanuts, tree nuts, dairy, soy, wheat/gluten, eggs, and sesame. Cross-contact is possible at every stage. We cannot guarantee that any product is free from any allergen, we do not test for allergens, and we accept no responsibility or liability whatsoever for any allergic reaction or other adverse effect. Always check the manufacturer's own packaging. If you have any allergy, do not purchase without confirming suitability directly with the manufacturer. By placing an order you acknowledge and accept these terms.

9. Prohibited Account Use

• You are responsible for keeping your account credentials and password secure.
• You agree not to use automated systems, scrapers, or “bots” to access our site or attempt to purchase inventory during limited product drops.
• We reserve the right to suspend or terminate accounts immediately if we suspect fraudulent activity, bot deployment, or any violation of these terms.

10. Intellectual Property

All content on this site, including text, website design, graphics, logos, product photos, and brand artwork, belongs to The Candy Room or its licensors and is protected by Canadian and international copyright laws. You are welcome to share links and post about us on social media with appropriate credit. Unauthorized commercial use or duplication of our content without written permission is strictly prohibited.

11. Limitation of Liability & Indemnification

• Limitation: To the maximum extent permitted by applicable Canadian law, The Candy Room’s total liability for any order is strictly limited to the exact amount you paid for that specific order. We are not liable for any indirect, incidental, or consequential damages resulting from your use of our site or consumption of our products.
• Indemnification: You agree to defend, indemnify, and hold harmless The Candy Room, its owners, and employees from any claims, damages, costs, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the website.

12. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision will be severed from the terms, but the remaining provisions will continue to be fully valid and enforceable.

13. Governing Law & Jurisdiction

These terms are governed exclusively by the laws of the Province of British Columbia and the federal laws of Canada. Any legal disputes or claims relating to your use of this website or purchases from The Candy Room must be resolved in the courts located in Vancouver, British Columbia.
